Texas’ drugged driving law prohibits a motorist from driving a vehicle while intoxicated, meaning not having the normal use of mental or physical faculties by reason of the introduction of a controlled substance, a drug, or a dangerous drug. So whether you are under the influence of marijuana or a prescribed medicine, any substance that causes you to drive without your mental or physical faculties is subject to a DWI arrest.

A first-time DWI offense is punishable by a maximum jail sentence of 190 days, a fine of up to $2,000, and license suspension for up to 2 years.
